Restraining Orders and Protective Orders

FAIRFIELD COUNTY ATTORNEYS — PROTECTIVE ORDERS

Restraining Orders in Connecticut

At Lovejoy & Rimer, our Fairfield County restraining order lawyers can help you understand the types of protections available and guide you through the legal process of obtaining the appropriate relief depending on your situation.

  • Temporary restraining order (TRO): Temporary restraining orders may be granted for a brief period of time with or without a hearing (ex parte). A TRO can protect an individual from alleged abusive conduct until a hearing is held.
  • Temporary injunction: A temporary injunction is a temporary court order that prohibits certain actions. A temporary injunction can be an effective method to maintain status quo during a divorce. A temporary injunction may prohibit a spouse from re-titling marital assets, calling a spouse’s employer or other actions. A temporary injunction may also address temporary child custody/parenting plan matters, property matters and other actions. They can be used to enforce Connecticut’s Automatic orders, which become effective when the divorce commences.

Connecticut Restraining Order Lawyers Providing Quality Legal Help in Domestic Violence Cases

The types of relief available in cases involving spousal abuse, stalking and other domestic violence cases are tailored to the issue at hand and the extent of protection necessary. Depending on the facts of the case, the court may order a temporary restraining order, which may include a no-contact order, an anti-harassment order, a restraining order or any other type of court-ordered relief. Our Fairfield County protective order attorneys offer skilled legal advocacy to clients in these cases, whether they are seeking protection from abuse or they face the imposition of a restraining or protective order due to false accusations.

Protective orders differ from restraining orders, which can be issued without an arrest taking place. Protective orders are issued by the court after someone has been arrested for a “family violence” crime. Family violence means an incident resulting in physical harm, bodily injury or assault or an act of threatened violence that constitutes fear of imminent physical harm, bodily injury or assault, between family or household members. Once a protective order has issued, violation of any of its provisions can have very serious consequences.
