What Is Mediation?
Both parties agree to work toward common ground in their divorce settlement. An independent mediator is typically assigned to oversee the negotiations. Parties may bring in their own experts such as child welfare specialists and property valuation experts to clarify issues or strengthen their case. When both parties agree to a settlement, it is presented to a judge to review it for fairness and legality. Neither party is legally bound to stick to the mediation agreement until the formal separation agreement is signed, and either may decide to pull out of the process and litigate a judgment. In many cases, a mediated or collaborative settlement is less likely to cause regrets and appeals for modifications several years in the future. It is often a less expensive option than trial.
